You know what your husband earns. The salary slip says ₹58,000 a month, but the school fee is ₹22,000 a quarter, the car EMI is ₹31,000, and there was a Singapore trip in December. If you are preparing a maintenance case, the question is not whether a judge will believe you. It is whether you can place the numbers before the court in a form it can act on. Learning how to prove husband income for maintenance means converting what you already know into documents, and then asking the court for the records only he can produce.
A maintenance court is not an income-tax assessing officer, and it does not need his taxable income to the rupee. Under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (which replaced Section 125 of the Code of Criminal Procedure), the magistrate asks whether the husband has sufficient means and whether the wife is unable to maintain herself. Under Section 24 of the Hindu Marriage Act, 1955, the family court looks at the income and other property of both spouses while the divorce petition is pending. Section 18 of the Hindu Adoptions and Maintenance Act, 1956 gives a wife a right to be maintained during the marriage, and Section 20 of the Protection of Women from Domestic Violence Act, 2005 allows monetary relief in a domestic violence proceeding.
In Rajnesh v. Neha, (2021) 2 SCC 324, the Supreme Court of India directed both parties to file an affidavit of disclosure of assets and liabilities in the format annexed to the judgment, so that the court works from sworn figures rather than allegations. Concealment invites an adverse view.
So the court is weighing four things: his gross and net income with perquisites, your own income and assets, the standard of living in the matrimonial home, and the number of dependants. Your evidence must speak to those four heads. It does not have to prove that he lied on his return.
Most of the paper trail can be assembled without any court order. Begin with what is already in the house or in your own name.
If you are a joint holder of any account, the bank will give you statements. Add-on credit card statements in your name show where the household money went. Loan sanction letters are often the single most useful document in the file, because a bank records income more generously than a tax return does: if you are a co-borrower on the home loan, you can obtain the sanction letter and the repayment schedule. Keep insurance premium receipts, the rent agreement and utility bills as well.
The EPF passbook against his UAN shows monthly basic pay and the employer's 12% contribution. Company records are public: search his name in the master data on the Ministry of Corporate Affairs portal if he is a director or shareholder, and check the GST portal for a proprietorship or firm registered in his name. Property sale deeds, index copies and encumbrance certificates are available at the sub-registrar's office.
One warning. Do not obtain documents by opening his email, phone or bank app without his consent. Accessing a computer resource without the permission of the owner is an offence under Sections 43 and 66 of the Information Technology Act, 2000, and it can destroy the credibility of an otherwise strong case.
An employer will not share an employee's salary structure with a spouse on request. That is the point at which you ask the court. In a family court, Order XI of the Code of Civil Procedure, 1908 permits discovery and inspection, and Order XVI covers summoning witnesses and documents. In a proceeding before a magistrate under Section 144 of the Sanhita, the court can direct production of records.
Frame the request narrowly: name the document, the period, the person and the custodian.
Direct M/s [employer], [address], to produce the salary register, Form 16 and full and final settlement statement for the period April 2023 to date in respect of [name], employee code [number].
A request for "all company records" will be refused as a fishing expedition. Expect a privacy objection; courts commonly call for records in a sealed cover and permit inspection of the relevant pages only. If he controls a document and refuses to produce it, the court is entitled to draw an adverse inference against him.
The faster route is usually the Rajnesh affidavit, filed with your interim application. It forces a sworn statement within weeks, and any later contradiction with bank or GST records becomes difficult to explain.
For a salaried husband you chase Form 16. For a businessman you read the balance sheet.
Capital account. A proprietor declaring ₹4.5 lakh of annual income while his capital account rises by ₹18 lakh owes the court an explanation.
Loans and charges. The balance sheet lists secured and unsecured loans; the bank file behind each loan usually states income optimistically.
Turnover mismatch. Compare GST returns with the turnover declared in the ITR.
Presumptive taxation. A businessman declaring profits under Section 44AD of the Income-tax Act, 1961 while running a household on ₹1.2 lakh a month gives the court a simple comparison to work with.
Assets and lifestyle inside the accounts. Depreciation on a luxury car, director's remuneration, dividends, and loans advanced to family members.
Cash. Large deposits in a parent's account, or property bought in a relative's name close to the separation.
Judges see a great deal of printout. What persuades is a small, indexed set where every item is tied to rupees and a date: the school fee circular and receipts, flight tickets and hotel invoices, passport visa pages, club membership, insurance premiums, rent for a flat he occupies separately, and the average monthly credit-card spend.
For social media, save the post with its URL, date and screenshot, keep the original file, and be ready to show the account belongs to him. Electronic records generally need a certificate under Section 63 of the Bharatiya Sakshya Adhiniyam, 2023, so take help on the format. Keep the language factual. "He posted photographs from a Dubai hotel in March 2025" is evidence. "He is a habitual liar" is not.
Consider a 34-year-old wife in Pune, married in 2017, with two children aged seven and three, who stopped working in 2022. Her husband files for divorce in 2025. His salary slip shows gross ₹58,000 and net ₹46,500 a month.
She gathers six things. A 2024 home loan sanction letter, on which she is a co-borrower, declares his annual income as ₹21.6 lakh with an EMI of ₹54,300. His ITR for AY 2025-26 shows total income of ₹9,84,000. Add-on credit card statements show an average monthly spend of ₹1.18 lakh, including school fee of ₹22,000, insurance of ₹9,400 and hotels of ₹18,000. The EPF passbook shows monthly basic of ₹29,000. A GST search reveals a proprietorship in his name with turnover of ₹19 lakh in FY 2024-25.
She files an application under Section 24 of the Hindu Marriage Act with an affidavit in the Rajnesh format, along with a petition under Section 144 of the Sanhita. His affidavit discloses only the salary. She then seeks directions to the employer for the salary register and to the bank for the account into which salary is credited. On the loan declaration, card spends and GST turnover, the court assesses his net monthly income at about ₹1.4 lakh and awards interim maintenance of ₹38,000 for her and ₹12,000 per child, plus ₹40,000 towards litigation expenses. The figure will vary with the judge and local practice. The method travels.
Collect three years of ITRs with all annexures, not just the acknowledgement
Download Form 26AS and the Annual Information Statement from the e-filing portal
Keep Form 16, twelve salary slips and the appointment letter in one folder
Obtain loan sanction letters where you are a co-borrower, and joint account statements
Prepare a one-page monthly household budget backed by receipts
Note down documents held only by him, his employer or his bank, for a production application
File the interim maintenance application along with the main petition, not months later
The first is filing only the salary slip and asking the court to guess the rest. The second is a vague affidavit claiming crores without a single document behind it. The third is volume without relevance: three hundred pages of chat screenshots with no money trail persuade nobody.
Do not hide your own fixed deposits, jewellery or income. The disclosure affidavit is mutual, and a false statement on your side damages the whole case. Do not delay the interim application either, because maintenance is decided on the record as it stands, and an early filing with strong documents sets the tone for everything that follows.
Your next step is a single sheet of paper. Write down his last known employer, his bank, the loan he took in 2024 and the three largest monthly expenses of the household, with the document that proves each one. That sheet becomes the index of your maintenance application, and your lawyer can build the affidavit around it.
